Ádám Remetei-Filep: Opinion with regard to Case C-333/21 European Super League Company, S.L. v Union of European Football Associations (UEFA) and Fédération Internationale de Football Association (FIFA). Nr. 2021/11.
The announcement concerning the Super League project of elite European football clubs resulted in a spectacular frenzy in the world of football and even outside of it back in April 2021. Nevertheless, after a few days the whole initiative seemed to collapse, nine out of the 12 founding clubs seemed to deeply regret their participation in the project and UEFA seemed to emerge victoriously from the fight. Case C-333/21 before the Court of Justice of the European Union is the still on-going legal battle between the same parties and it might still have a long lasting effect on European football. This opinion takes a closer look at the actual provisions relevant for the competition law assessment of this dispute and discusses the most relevant aspect of the case.
