János ERDŐDY: A PAPYRUS OF THE DRUSILLA LAWSUIT AND ITS IMPACT ON ROMAN LAW. Nr. 2020/08

Amongst the primary sources of lex Laetoria, a Roman act from around the turn of the 3rd and 2nd centuries BC, granting additional protection to adults under the age of 25, a Greek papyrus (BGU II 378) comes up as a document preserving the name of the act. This papyrus is remarkable from a legal point of view: it contains a petition for the suspension of execution related to a contract of loan. In the text, the petitioner supports his claim with the fact that a key written document, a khirographum, in which he admits his obligation to pay was a result of an act of extortion. Beyond the actual case, this papyrus is significant because it outlines the social and economic milieu of the Roman world in Egypt around the 2nd century AD. Through the examination and analysis of the case in this papyrus, we get closer to the everyday reality of Roman law. The characters involved in the case bear Roman names, the case takes place in the Faiyum Oasis, in Egypt, the correspondence is in Greek and Roman law measures are used to settle the dispute. We sense multiculturalism in this one document, without the disturbing feeling of having lost or altered something important which may contribute to our specific character. In other words, we see an example of how Rome had managed to handle herself as an Empire.

This short paper is aiming to give a glimpse of this multicultural approach of Roman law in action through the analysis of the case in the papyrus BGU II 378.

Sarolta MOLNÁR: The Promises We Make… and Break. Nr. 2020/07

Bitter human experience is that those closest can hurt us the most, while this is part of life, extreme cruelty and causing dignitary harm has its legal response. In marriage there are explicit legal obligations the breach of which might result in marital breakdown. Some of these used to be criminal offences and fault grounds for divorce, nowadays their legal value is a question. A number of jurisdictions are beginning to find personal injury claims as a possible legal response for these infringements.

Milyen olyan kérdések vannak a jogban, amelyekre adatokra hivatkozva válaszolunk? Hogyan olvashatók egyszerűen ezek az adatok – különösen, ha nagyon sok különböző van belőlük? Kiolvasható-e adatokból az, hogy az egyik jelenség okozza a másikat, vagy hogy egy személy jellemzője okozza-e azt, hogy hogyan viselkedik, milyen helyzetekbe kerül? Ha sok adatok ismerünk, de nem ismerjük mindet (például bizonyos emberek adatait ismerjük, de nem ismerjük mindenkiért), akkor következtethetünk-e azon adatokra, amelyeket nem ismerünk? Mikor? Benda Vivien: An overview about the implementation of the Sustainable Development Goals. Nr. 2020/05.

A globális elköteleződést megkövetelő Fenntartható Fejlődési Célok implementálási időszaka 2015 és 2030 közé esik, így bár még látszólag van idő a megvalósításra, különös fontossággal bír az ENSZ által a kitűzött célok realizálásáról szóló 2019-es jelentés. A tanulmány egyrészt a jelentés alapján kívánja ismertetni az implementálás aktuális helyzetét, továbbá az célokat érintő változásokat, kihívásokat, esetleges megoldási lehetőségeket. Másrészt, az előbb említett törekvés kontextusba helyezése érdekében megvizsgáljuk a Fenntartható Fejlődési Célok rendszerét, mint a nemzetközi jog soft law dokumentumát, illetve annak jelentőségét, integrálódását és kapcsolódási pontjait más, soft, illetve hard law nemzetközi dokumentumokkal, annak érdekében, hogy komplex képet kapjunk a realizálás aktuális állásáról és beazonosítsuk a célok által érintett területek legkiemelkedőbb instrumentumait.

János Erdődy: Lex Laetoria: Why so difficult? Nr. 2020/04

Lex Laetoria as a piece of Roman legislation from around 200 BC ordered that adults under the age of 25, the so-called minores, while having full capacity, are granted additional legal protection in the form of a guardian (curator), and additionally a criminal action (actio poenalis), a presumable actio popularis, could be brought against the person who duped a minor in order to play upon their susceptibilities or naiveté. On the grounds of this law, further praetorian remedies were made eligible against the duper, with two different options: the one was exceptio, applicable in case of being sued for completion by the other party, whereas the other was in integrum restitutio, available in case of apparent damage of the minor in the absence of any other remedies, which practically referred to an after-completion phase of the contract in question.

This short paper is aiming to present lex Laetoria not from a scientific, but rather from an educational aspect, trying to outline some general difficulties of legal education, and many of the challenges realted to this particular legislative measure in Roman law. Through the presentation of a classical case, the case-based approach of Roman jurists could also be presented via this act, and the extensions carried out in praetorian edict.
