Szilágyi Pál: The evaluation of the Hungarian sector inquiry in the online travel market. Nr. 2017/16.

Recently there is increased focus on the travel markets.[1] The Hungarian Competition Authority carried out a market analysis on the market of online hotel bookings. The final report was adopted in May 2016.[2] In this article, we will first give a detailed overview of the report and after that offer some comments on it.

Wágner Tamás: A bányajáradékok és a szelektivitás kritériuma, avagy a MOL állami támogatásának ügye. Nr. 2017/15.

Az eset jól jellemzi az állami támogatások jogának, illetve a szelektivitás kritériumának bonyolultságát. Mielott az elemzésre rátérnénk, érdemes egy rövid kitekintést tenni az uniós jog e területén, hogy jobban megértsük az ügy hátterét. Így kezdjünk is hozzá!
Az állami támogatással kapcsolatos politika az egyik legfontosabb, de leginkább vitatott terület ma Európában. Köztudott, hogy a szabad verseny és a torzítatlan piac elvei a legfontosabbak az Európai Unióban. Így legitim célnak tunik, hogy a tagállamok által nyújtott támogatásokat ellenorzik. Ugyanakkor mindez egyedi vonása az uniós versenypolitikának: csak az EFTA-nak van hasonló szupranacionális rendszere. Éppen ezért azt mondhatjuk, hogy ez egy ritka szabályozás, még szövetségi államokban is: az USA-ban sem létezik ehhez hasonló mechanizmus,
Így rögtön adódik a kérdés: miért kell mindezt uniós szinten rendezni? Ugyanis a fejlesztéspolitika a tagállamok szempontjából meghatározó és rendszerint a kormányok határozzák meg, hogy a gazdaság mely területe szorul támogatásra.

Béla Pokol: Der juristokratische Staat (Entstehung, Aspekte, Verzerrungen und Möglichkeiten zur Sublimierung). Nr. 2017/13.

Die Verrechlichung der Politk wurde schon sehr früh von Otto Kirchheimer aufgeworfen und in den letzten Jahrzehten hat die Diskussion darüber immer neulich aufgeflammt. Die Analysen erweiterten diese Erscheinung und schon auch die gegenseitige Durchdringung der Politik und des Rechts wurde behauptet. Daneben haben die Analysen über die zunehmenden Kompetenzen der Verfassungsgerichte dazu gefürt, um behaupten zu haben, dass es sich hier um die Umwandlung des Rechtsstaates zum Richterstaates handelt (Bernd Rüthers) und die staatliche Regierung schon auf die Richter basiert sind (Alec Sweet Stone). In dieser Schrift möchte ich diese Gedankenrichtung aufnehmen und in einer ausführlichen Analysen versuche ich es, die Entstehung, die Aspekte und die Verzerrungen der immer mehr auf juristische Argumentation basierte Typ des Staates offenzulegen. Ich benutze für seine Benennng den Name von juristokratische Staat und nicht “Richterstaat”, damit die neutrale Beschreibungsweise nicht sofort mit kritischen Obertonen zu vermischen.

Tóth Tihamér: State supported cartels. Nr. 2017/12.

State and private competition restrictions can be closely connected. Hybrid cases[1], involving agreements and decisions of undertakings that would be caught by antitrust rules and a corresponding state action give rise to various challenging legal issues. States, as part of their toolkit to shape economic policy, encourage, support or approve market conduct that would normally be condemned as a price or market sharing cartel. The State may also decide to authorise a chamber or other association to regulate market entry, quality of services or prices. In this paper I focus on how state involvement may impact on corporate or individual antitrust liability. The aim is to give an overview of those defenses which companies invoke to defend their cartel-like activities or abusive behaviour whenever they acted under state influence, often manifesting in the form of a legislative or regulatory act.

[1] By `hybrid cases` I refer to cases where there are two connected actions, one on the side of a state entity, another by an undertaking. In theory, both the state and the companies could be held liable.
